Terms of Service

These Terms of Service (“Terms”), together with the Privacy Policy (collectively, the “Agreement”), form a legally binding agreement between you (“you”, “your”, or “User”) and Radi Credit Limited (“Radi Credit”, “Company”, “We”, “Us”, or “Our”), a company incorporated under the laws of the Republic of Kenya, located at Plot No. 209, Commodore Offices, Kindaruma Lane, Ngong Road, Kilimani, Nairobi.

Terms of Service

By accessing, downloading, or using the Radi Credit mobile application, website, USSD service, portal, or any related digital platform (collectively, the “Platform” or “Site”), or by applying for, receiving, or repaying any digital credit (the “Loan” or “Service”), you expressly agree to be bound by this Agreement.

You confirm that you are at least eighteen (18) years of age and capable of entering into a binding contract under Kenyan law.

If you do not agree with any part of this Agreement, you must immediately discontinue use of the Platform and Services. Your continued use following any updates constitutes acceptance of the revised Terms.

This Agreement governs your general use of the Platform. Specific Loans are also governed by separate Loan Agreements (including terms on principal, interest, fees, repayment schedule, and penalties), which prevail in case of conflict.

We act as the digital credit provider, and Loans are sanctioned subject to our credit assessment and compliance with the Central Bank of Kenya (Digital Credit Providers) Regulations, 2022, the Data Protection Act, 2019, the Consumer Protection Act, 2012, and other applicable laws.

Definitions

Account
Your registered profile on the Platform for accessing Services.
Loan
Any credit extended to you via the Platform, governed by a separate Loan Agreement.
Platform
The Radi Credit mobile app, website, USSD, or related digital channels.
Personal Data
Has the meaning under the Data Protection Act, 2019.

User Eligibility & Approval

You must be a Kenyan resident aged 18 or above to use the Services. By registering or applying for a Loan, you consent to:

  • Our verification of your identity, creditworthiness, and information (including via Credit Reference Bureaus).
  • Processing of your Personal Data as detailed in the Privacy Policy.

We reserve the right to reject any Loan application, even if previously approved, or to suspend/terminate your Account if information provided is inaccurate, incomplete, or misleading.

Provision of Services

The Platform enables you to apply for Loans, manage repayments, and access related features. Loans are subject to our approval, credit policy, and regulatory requirements.

We or our partners may reject applications or modify Services at our discretion, with or without notice.

You are responsible for all data charges incurred while using the Platform.

Your Obligations

You agree to:

  • Provide accurate, current, and complete information.
  • Use the Platform only for lawful purposes permitted by this Agreement and Kenyan law.
  • Not share your Account credentials or allow unauthorized access.
  • Comply with all Loan repayment terms to avoid penalties, default listing with Credit Reference Bureaus, or other consequences.

Restrictions on Use

You shall not:

  • Access the Platform by unauthorized means or circumvent security features.
  • Copy, reproduce, modify, reverse engineer, decompile, or disassemble any part of the Platform.
  • Use robots, spiders, scrapers, or automated tools to collect data.
  • Transmit viruses, malware, or harmful code.
  • Overload, disrupt, or attack the Platform or related systems.
  • Collect or misuse other users' information.
  • Engage in fraudulent, unlawful, or harmful activities, including spam or unauthorized advertising.
  • Infringe intellectual property rights or violate any law/regulation.

Violation may result in immediate Account suspension/termination, legal action, and reporting to authorities (e.g., Central Bank of Kenya).

Intellectual Property

All rights, title, and interest in the Platform, content, trademarks, logos, software, and materials are owned by Radi Credit or its licensors.

You are granted a limited, non-exclusive, non-transferable license to use the Platform for personal, non-commercial purposes only. You must not remove, alter, or obscure any proprietary notices.

Termination

We may suspend or terminate your access to the Platform or Services if:

  • Required by law or regulation.
  • You breach this Agreement or any Loan Agreement.
  • We reasonably suspect misuse, fraud, or risk to the Platform.
  • Continued provision is no longer viable.

You may cease using the Platform at any time, but outstanding Loan obligations survive termination. Accrued rights, obligations, and liabilities (e.g., repayment, indemnification) continue indefinitely.

Limitation of Liability & Indemnity

To the maximum extent permitted by law:

  • The Platform and Services are provided “as is” without warranties (express or implied), including uninterrupted availability, error-free operation, or fitness for a particular purpose.
  • We are not liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from your use of the Platform, Loans, or third-party actions (including Lenders of Record, if applicable).
  • You indemnify and hold Radi Credit, its officers, employees, and agents harmless from claims, losses, liabilities, or expenses (including reasonable legal fees) arising from your breach of this Agreement, misuse of Services, or violation of law.
  • We are not liable for acts/omissions of third parties, including payment processors or Credit Reference Bureaus.

No Warranties

We make reasonable efforts to maintain the Platform securely and reliably but disclaim all warranties regarding availability, security, compatibility, or absence of errors/viruses.

No advice or information from us creates additional warranties.

Notices & Changes

We may send notices via the Platform, email, SMS, or phone. Notices are deemed received within 3 days of sending; continued use constitutes acceptance.

We may update this Agreement. Material changes will be notified via the Platform or email at least 30 days in advance where required by regulation. Continued use after changes indicates acceptance.

Governing Law & Dispute Resolution

This Agreement is governed by the laws of the Republic of Kenya.

Disputes shall be resolved amicably first, failing which, through negotiation or referral to the Central Bank of Kenya mechanisms, or exclusive jurisdiction of Nairobi courts.
